Grade is developed by Sofapps di Costantino Pistagna, VAT number 05197020877, who can be reached at info@sofapps.it.

Acceptance
By downloading, installing or using Grade you accept these terms. For the app downloaded from the App Store, Apple's standard licensed application end user agreement also applies. If you don't accept these terms, don't use the app.
What Grade is, and what it isn't
Grade is a training tool: it controls the gradient or resistance of your trainer, records your rides and calculates indicators such as load, thresholds and estimated power. Many of these numbers are estimates, built on published models and on the data you provide, and may be inaccurate.
Grade is not a medical device within the meaning of Regulation (EU) 2017/745, it doesn't make diagnoses and it doesn't replace either a doctor's opinion or the work of a professional coach.
Your health
Training on a trainer or on the road is intense physical activity. Before starting a training programme, and whenever you have a doubt about your health, it is always better to have a sports medical check-up.
Stop training immediately if you feel chest pain, unusual shortness of breath, dizziness, palpitations or any other symptom, and see a doctor. The targets, zones and gradients the app suggests are general guidance: adapt them to yourself, your conditions and your fitness.
Responsible use
By using the app you undertake to:
- set up and use the trainer according to the manufacturer's instructions, on a stable surface and with the bike correctly secured;
- not look at or touch the phone while riding on the road, and comply with the highway code: outdoor recording works without your having to look at the screen;
- keep the data the app uses up to date in your profile, such as weight and thresholds, because the calculations depend on them;
- use the app for training, which is the purpose it is made for.
Liability
To the extent permitted by law, Sofapps di Costantino Pistagna is not liable for damage arising from use of the app that does not comply with these terms, from failure to follow the safety instructions, from the interpretation of the numbers shown, or from the malfunctioning of third-party devices, sensors and services.
Compatibility
Grade works with trainers and smart bikes that use the Bluetooth FTMS standard, and with Bluetooth heart rate, cadence and power sensors. We can't guarantee that it works with every model: third-party devices may behave differently from what the standard provides. Device names and brands belong to their respective owners.
Grade PRO and purchases
Some features are available with the in-app purchase Grade PRO, which is paid once only. Price, payment, invoicing and refunds are handled by Apple under the App Store terms. If you change device, you recover the purchase with “Restore purchases”.
Apple services
iCloud, Health, Maps, weather (WeatherKit) and the App Store are Apple services, governed by Apple's terms. Their operation does not depend on us.
Changes
We may update the app and these terms. The version in force is the one published on this page, with its date.
Governing law
These terms are governed by Italian law. For any dispute the courts of Catania have exclusive jurisdiction. If you are a consumer, the court of the place where you reside or are domiciled remains competent by law (article 66-bis of the Italian Consumer Code, Legislative Decree 206/2005).
